No one has been fined yet, and they are being sold all the time. Its a completely toothless "threat"

Its a nonsense clause that is basically unenforceable. Its silly they even put it in there.

No. Reselling short supply should be illegal.

Like people who resell concert tickets for profit.

I'm not saying Tesla is in the right here, but a lot of people plan to get into the buying waiting list just so they can resell a higher price.

            Good move by Tesla.

That's why it's a good thing when manufacturers/retailers make an effort to limit scalping. It only harms the consumer who is forced to overpay for an item.

A private company has no way to enforce such a fine. Just don't pay it, they can't lock you up for it, they will spend more money trying to pursue you in civil court than 50k, it's a bluff.

They could take him to court over it since it was part of the contract he signed.

They would lose tens of millions of dollar if they did, probably more. The negative image and push back would be extreme. Plus, if they go after one owner, they would have to go after every person who has sold their cybertruck. The would lose a stupid amount of money so they wont do anything.

True but there are various levels contracts and this is a pretty minor one. It likely isnt 100% legal to begin with, its mostly there for scare tactics and to keep Tesla in control of the price. But the depreciation is so extreme people dont give a shit. Tesla is also breaking the "contract" but not delivering Foundation trucks as ordered. Enforcing that fine is a hornets nest they dont want to and arent going to step in.

Nah probably not, which is why they havent taken anyone to court yet. Taking peoples money and not delivering the product as paid for is bad. Trying to "fine" someone for selling a product that was delivered incomplete is even worse. Even in the low chance Tesla wins, that result would destroy their sales and reputation.

If he can get through to the right people they would probably waive the fine in this case, provided he doesn't sell it above MSRP.
That's why he's posting it on reddit or whatever, if he makes a big enough stink they'll make an exception to curb the negative PR.

      >without issue
Depreciation is already kicking in pretty hard so its tough to sell them at MSRP. When the non-foundation trucks come out with the alleged 80k MSRP, that will absolutely frick value foundation owners. This is why a lot of people are trying to get rid of them asap.

If you aren't allowed to sell the car/truck/whatever than they should have to legally call it a rental or a lease or something and not a sale. If you can't sell it then you don't own it. You didn't buy a Tesla, you licensed the use of it.
You're an automotive rentoid and Musk isn't going to give you back you deposit - but at the very least he shouldn't be allowed to say he 'sold' you a truck, since he didn't.
